This page outlines the terms and conditions which apply to you purchasing goods listed, from GodGear Apparel, through our website.  

 

By using this Website, you are agreeing with these terms and conditions together with our Privacy Policy, regardless of whether you are a registered member, a regular buyer or a new/one-time buyer. Alternatively, if you do not accept these terms and conditions, we ask that you do not shop or purchase anything on this website. 


 

CLAUSE 1: INFORMATION ABOUT US

www.godgearapparel.com is a site owned and operated by GodGear Apparel Ltd; (occasionally referenced as “we” or “us” in this article). We are registered in England and Wales under and with our registered office at [ADDRESS]. CLAUSE 2: SERVICE AVAILABILITY 

We currently only ship to buyers within the UK. More information can be found on our Delivery Information page.


 

CLAUSE 3: YOUR STATUS 

By placing an order through our website, you are claiming to be:

  • Legally capable of entering into binding contracts;

  • At least 16 years of age; and,

  • Are a resident in one of the countries we deliver our services too. 


 

CLAUSE 4:  PROCESSING AN ORDER 

Systematically orders are put through by completing the process as required on the website as set out below:

  • Adding your desired product(s) to your shopping basket

  • Enter log in details or registering as a new member

  • Enter delivery address details for your product(s) to be dispatched to

  • Enter billing address details for where your purchase can be billed to.

  • Order Confirmation that we have received your product request and are going to pack the item.

 

CLAUSE 5: THE AUTOMATED CONTRACT FORMED BETWEEN YOU AND US WHEN A PURCHASE HAS BEEN MADE

After placing an order, you will receive an e-mail from us acknowledging that We have received your order. Your order only constitutes an offer to purchase goods from us, and does not form a binding contract until it has been accepted by us. Where you order more than one product your order contains a series of offers for each product individually. On receipt of your order, we will send you an order acknowledgement email to the email address which you provide in the order process.

 

This order email will act as an acknowledgement as to what you have ordered and will contain your order number, details of the goods ordered and a delivery estimate. Note that this email is only to acknowledge that your order has been received, and is not acceptance by us of any offers to purchase goods. We reserve the right to refuse any offers in an order prior to acceptance.

 

We will confirm such acceptance to you by sending you an e-mail that confirms that the product(s) has been dispatched (the "Dispatch Confirmation"). The contract between us ("Contract") will only be formed when we send you the Dispatch Confirmation.

 

We will not process your order until payment has been received in full in accordance with the provisions of clause 7. Where you select to pay by credit or debit card we will process the payment at the time of preparing your goods for despatch.

 

If a product is not available we will include details of the unavailable product in the order despatch email. A product which is not available will not be included in the contract for a product which is despatched. The charge for the unavailable item will be refunded to the original payment method and will reflect in your account in the same time span as any other refund we issue. Please refer to the Returns and Refund policy for further detail. 

 

As soon as you place your order, we start to process your order which means you will not be able to change it before delivery, but you may be able to return your Products under clause 8 of these terms and conditions or under our Returns and Refund policy

 

We are entitled to refuse any order made by you for any reason.

 

When making a request you undertake that all details you provide to us at the time of sale/purchase are true and accurate. This includes;

  • Being the authorised user of the credit or debit card used to make your order 

  • Having sufficient funds to cover the cost of the goods and services. 

It is your responsibility to inform us of any changes to these details as soon as possible.


 

CLAUSE 6: YOUR CONSUMER RIGHTS 

If you are contracting as a consumer, you may cancel a Contract at any time within seven days, beginning on the day after you received the product(s). 

 

If you are an UK or EEA user, as per the agreement, you may cancel a Contract any time within 14 days. In this case, you will receive a full refund of the price paid for the Products in accordance with our Returns and Refund policy


 

CLAUSE 7:  DELIVERY 

We aim to always deliver your order by the delivery date set out in the Dispatch Confirmation email. If for whatever reason we do not provide a delivery date, then please allow for a 30 day - window from the date in which the Dispatch Confirmation email was recieved, unless there are exceptional circumstances.

 

If you wish to dispute the delivery of your order, you have 14 days starting from the day you order was fulfilled (i.e. updated as delivered to the address set out in the Dispatch Confirmation). We reserve the right to request evidence, before issuing any refund of the price paid and/or any associated delivery costs. For more information check out our Delivery page


 

CLAUSE 8: PRICE AND PAYMENT 

  • Each product enlisted on the website will also detail the price. Prices advertised on the Website will include UK VAT but excludes delivery charges. Delivery charges are shown separately when ordering and must also be paid in advance. 

  • Payment shall be made by you by the means specified on the website. 

  • Prices are subject to change without notice but changes will not affect orders which we have already accepted.

  • Payment for all Products must be by credit or debit card. We accept payment with Visa, Visa Debit, Mastercard, Solo, Maestro, Electron and Laser Card. We also accept payments via PayPal.

  • All prices advertised are subject to such changes.

  • Only one promotion code can be used per order.

CLAUSE 9: RETURNS and REFUNDS

CLAUSE 10: COMMUNICATION METHODS 

Our main method of communication will be virtual/online/social media based and therefore, when using our site, you accept that communication with us will be mainly electronic. Typically we will contact you via e-mail or provide you with information via notices posted on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that We provide to you electronically comply with any legal requirement that such communications be in writing. 


 

CLAUSE 11: OUR LIABILITY 

  • If 

    • We do not deliver 

    • The product(s) we deliver are not what you ordered

    • The delievered products are damaged or defective 

    • The delivery is of an incorrect quantity

Our only obligation will be, at our option to:

  • Make good any shortage or non-delivered items or incorrect items; or

  • Replace any product(s) that are damaged or defective; or

  • Refund to you the amount paid for the product(s) in question.

 

If you discover that your product is faulty after 14 days we reserve the right to request evidence, such as images of the defect, before issuing any refund of the price and/or any associated delivery charges.


 

CLAUSE 12: INTELLECTUAL PROPERTY RIGHTS 

All designs, concepts, ideas and intellectual property are all subjected to the Intellectual Property Rights. All products released by us shall then be owned by us and our enlisted collaborators depending on the product/design in question. All shares from intellectual rights to profit splits will be discussed with an agreement made to establish the shares.  


 

CLAUSE 13: INDEMNITY 

You agree to indemnify, defend and hold harmless Godgearapparel.com Ltd, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your breach of these terms and conditions, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.


 

CLAUSE 14: EVENTS OUTSIDE OUR CONTROL 

  • We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this contract that is caused by events outside our reasonable control ("Force Majeure Event").

  • A Force Majeure Event includes any act, event, unforeseen, omission or accident beyond our reasonable control, which includes (but limited by) the following:

    • Strikes, lock-outs or other industrial action.

    • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

    • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.

    • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

    • Impossibility of the use of public or private telecommunications networks.

    • The acts, decrees, legislation, regulations or restrictions of any government.

  • Our performance under this contract is deemed to be suspended for the duration that the Force Majeure Event occurs, therefore granting us an extension of time for performance and deliever our service to you (the consumer). We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under this contact may be met despite the Force Majeure Event.


 

CLAUSE 15: AFTER THE SALE 

You may have questions, comments or requests regarding these terms and conditions set out before you. These can all be addressed to our [EMAIL ADDRESS]

We strongly believe that you will have a pleasurable experience when shopping at GodGear from order to delivery. However, on the off chance that issues arise any comments, queries or complaints about our product(s) or service should be addressed to [EMAIL ADDRESS]. 


 

CLAUSE 16: OUR RIGHT

  • We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in current laws and regulatory requirements and changes in our system's capabilities or for any other reason in our sole discretion which we may decide as we deem necessary.

  • You will be subject to the policies and terms and conditions in force at the time that you order products from us, or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).


 

CLAUSE 17: TRANSFER OF RIGHTS AND OBLIGATIONS 

  • You may not transfer, assign, charge or otherwise dispose of this contract, or any of your rights or obligations arising under it, from without our prior written consent.

  • We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.


 

CLAUSE 18: DISCOUNT CODE TERMS AND CONDITIONS

Discount Codes entitle you to an extra percentage off your online order which can ONLY be redeemed from www.godgearapparel.com. To claim your discount,  simple type or copy the discount code and click on the shopping cart in the top right hand of the website. You will be asked to log in or (if already logged in) will take you to your shopping bag. You will be provided with an option to “Apply Discount”, where you will enter the promotional code in order first and then click apply discount to apply it to the order.

 

Discount Codes and related offers are NOT open to employees of PrettyLitttleThing.com and we reserve the right to withdraw them and refuse or restrict any order at any time.

 

Discount Codes can only be used once per customer, and cannot be used in conjunction with any other promotion or offer.
